RE: The tariff classification of a floor box flange and a floor box cover plate made in China

Dear Mr. D’Andrea:

In your letter dated August 28, 2008, on behalf of Wiremold, you requested a tariff classification ruling. Samples of the floor box flange and floor box cover plate were submitted for our review.

The products are identified in your letter as a rectangular chrome-plated brass floor box trim flange (item number 817C-CCP) and a circular brass floor box cover plate (item number 896TCK-1/2). Both items are designed to be used in industrial applications with electrical boxes. The floor box trim flange measures approximately 5¾ inches in length by 4¾ inches in width. The item has four threaded holes to allow the flange to be attached to an electrical box in the floor, two holes to allow an electrical outlet receptacle to be secured to the flange and four holes to allow a floor cover plate to be attached to the flange. A bag of eight screws will be included with the flange.

The floor box cover plate measures approximately 4¼ inches in diameter. The item has three drilled holes to allow the cover plate to be attached with screws to an electrical box in the floor. The cover plate features a center screw plug that can be removed to allow access to pull cable through the opening. You indicate in your letter that the cover plate may be imported with the threaded 2½ inch center plug. A bag of four screws and a gasket will be included with the cover plate.

The samples will be returned as requested.

The applicable subheading for the floor box flange and floor box cover plate will be 7419.99.5050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of copper, other, other, other, other, other. The rate of duty will be free.
